Paul Golden is Special Counsel to Haworth Barber & Gerstman, LLC, and concentrates his practice on motion and appellate litigation in New York State and federal courts. He has argued more than 70 appeals, including two before the New York Court of Appeals, where his victories reshaped state law on administrative powers and insurance coverage. One of those decisions has since been cited hundreds of times and was recognized by Mealey's Litigation Reports as one of the nation's ten most significant insurance coverage rulings of the year.
Mr. Golden has secured numerous dispositive victories at both the trial and appellate levels. These include winning summary judgment for the defense in a wrongful death case where plaintiff alleged the building owner's unlocked doors led to a murder on the premises; winning summary judgment in favor of the defense in a case where the plaintiff lost her foot after being run over by a vehicle; and obtaining dismissal of claims in a case where a child allegedly slipped through the spacing on a building's landing and fractured his leg. He has also obtained dismissal of Labor Law and negligence claims, enforcement of indemnification provisions, and vacatur of a $1.3 million judgment. In addition to his appellate work, he litigates commercial and real estate cases, including actions involving adverse possession and constructive trust claims.
Mr. Golden is the author of two treatises for practitioners published by the American Bar Association: Litigating Constructive Trusts (2022) and Litigating Adverse Possession Cases (2024). Both are the first comprehensive works in their fields and are available in leading law libraries, including Harvard, Yale, and the University of Chicago. He has also published extensively in the New York State Bar Association Journal and other legal outlets, with articles cited in federal and state cases.
He has taught continuing legal education (CLE) programs for attorneys on constructive trusts, adverse possession, and deposition practice. He has been quoted by Newsweek, Forbes, Money, the ABA Journal, and the Commercial Observer.
